Terms of Service

These Terms of Service ("Terms") govern your access to and use of the WebWork CRM LLC platform, websites, and mobile applications (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms on behalf of yourself and the company you represent ("Customer", "you").
1. The Service
WebWork provides software for field-service businesses, including scheduling, routing, customer management, invoicing, payment processing integrations, a customer portal, and a technician mobile application. We may add, change, or remove features over time; material reductions to functionality you have paid for will be communicated in advance where reasonably possible.
2. Accounts & responsibilities
- You must provide accurate company and contact information and keep it current.
- You are responsible for safeguarding account credentials and for all activity under your accounts, including those of staff users you create.
- You must be at least 18 years old and authorized to bind the company you register.
- You agree not to misuse the Service — including attempting to access other tenants' data, probing or disrupting the Service, reselling it without authorization, or using it to send spam or unlawful communications.
3. Your data
You retain all rights to the data you and your team enter into the Service, including your customers' information ("Customer Data"). You grant us a limited license to host, process, back up, and display Customer Data solely to provide and support the Service. We access Customer Data only to operate the Service, comply with law, or with your permission to provide support. Our handling of personal information is described in our Privacy Policy.
You are responsible for the lawfulness of the Customer Data you collect and process through the Service, including obtaining any consents required to contact your customers by email or SMS. For SMS in particular, U.S. law (TCPA) generally requires prior express consent — and prior express written consent for marketing texts. The Service records customer SMS consent and honors opt-outs (e.g., STOP replies); you agree to send only to customers who have consented.
Where you or your customers are subject to data-protection laws, our Data Processing Addendum is incorporated into these Terms and governs our processing of personal data on your behalf, including the subprocessors we use.
4. Trials, plans & billing
- Free trials run for the stated period (typically 14 days) with no payment method required. At the end of a trial, access is suspended until a paid subscription is activated; your data is retained for at least 30 days after suspension so you can pick up where you left off.
- Paid subscriptions are billed per plan and per route (technician schedule) as described on our pricing page. Prices may change with at least 30 days' notice; changes apply at your next billing cycle.
- Subscriptions are month-to-month unless otherwise agreed. You may cancel at any time, effective at the end of the current billing period. Fees already paid are non-refundable except where required by law.
5. Payment processing
Payments you collect from your customers through the Service are processed by third-party processors (e.g., Stripe) under your own agreement with the processor. We are not a party to transactions between you and your customers and are not responsible for processor fees, chargebacks, or disputes.
6. Availability & support
We work to keep the Service available and performant but do not guarantee uninterrupted availability. Planned maintenance will be scheduled to minimize disruption where practical. Support is provided by email during business hours.
7. Termination & data export
You may export your Customer Data (CSV) at any time from the Service. We may suspend or terminate access for material breach of these Terms (including non-payment) after reasonable notice. Following termination, we will make Customer Data available for export for at least 30 days, after which it may be deleted from production systems.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS OR REVENUES. OUR AGGREGATE LIABILITY ARISING OUT OF THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.
10. Indemnification
You will defend and indemnify us against third-party claims arising from (a) Customer Data you submit to the Service, (b) communications you send through the Service without required consent (including TCPA/CAN-SPAM claims), or (c) your use of the Service in violation of law or these Terms. We will defend and indemnify you against third-party claims that the Service itself infringes their intellectual-property rights.
11. Governing law & disputes
These Terms are governed by the laws of the State of Florida, without regard to its conflicts rules. The parties will first try in good faith to resolve any dispute informally; failing that, exclusive venue lies in the state or federal courts located in Palm Beach County, Florida, and each party consents to their jurisdiction.
12. Trademarks
WebWork™, the WebWork logo, and related marks are trademarks of WebWork CRM LLC. These Terms grant no rights to use them except to identify your use of the Service.
13. Text messaging (SMS) program terms
These terms apply to service-related text messages sent by WebWork and by the field-service businesses using the Service ("the SMS program").
- Program description. After you opt in, the SMS program sends service-related messages such as appointment reminders and confirmations, technician arrival and job-completion notifications, invoice and payment reminders, and replies to messages you send.
- Consent. You opt in by providing your mobile number and agreeing to receive texts. Consent is not a condition of purchasing any goods or services.
- Message frequency varies based on your account activity and service schedule.
- Message and data rates may apply according to your mobile carrier plan.
- Opting out. Reply STOP to any message to cancel at any time; you will receive a final confirmation message. Reply HELP for help, or contact support@webworkcrm.com.
- Carriers are not liable for delayed or undelivered messages.
- Mobile opt-in and consent data is never shared with third parties or affiliates for their own marketing purposes. See our Privacy Policy for how personal information is handled.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified by email or in-product notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
